We prepare analyses and draft legal opinions in the scope of regulatory issues. We analyse issues related to the fulfilment of licensing conditions by entities conducting licensed activities. We assess the legitimacy of decisions issued by the President of ERO and the chances of their revocation or amendment. We verify the inspection activities carried out by designated employees of the Energy Regulatory Office in the scope of controlling licensed activities in terms of their compliance with applicable legal provisions.
We provide legal support related to the preparation of applications for the issuance of certificates of origin for electricity from renewable energy sources and agricultural biogas by the President of ERO. We provide legal assistance to entities obliged to submit certificates of origin for electricity generated from renewable energy sources for cancellation.
We provide comprehensive legal services in disputes conducted with energy enterprises. We handle disputes arising in connection with the inability to provide (or increase) connection capacity or the necessity to restrict connection capacity, as well as disputes related to the performance of agreements executed by energy enterprises – e.g.: electricity sale agreements, agreements for the provision of fuel or energy transmission or distribution services, agreements for the provision of natural gas transport services, agreements for the provision of gaseous fuels storage services, agreements for making available a part of an energy storage facility, agreements for the provision of natural gas liquefaction services, and comprehensive agreements. We also conduct disputes related to the suspension of the supply of gaseous fuels or energy, the refusal to connect a renewable energy source installation or road public transport charging infrastructure or a publicly accessible charging station in the first instance, as well as the refusal to connect a micro-installation, the unjustified restriction of operation or disconnection of a micro-installation from the grid, or the refusal to amend an agreement regarding the date of the first delivery of electricity to the grid. In the aforementioned disputes, in the absence of reaching an agreement with the energy enterprise, we represent our clients in proceedings before the President of ERO.
We provide comprehensive legal services in the processes of drafting and submitting tariffs for approval. We actively participate during the preparation of documents submitted to the President of ERO by our clients, related to the approval, amendment, and control of the application of tariffs for gaseous fuels, electricity, and heat, in terms of their compliance with the principles set out in the act and implementing regulations. We prepare appeals against decisions refusing the approval of energy tariffs.
