    Public Procurement Law – Legal Support for Foreign Contractors in Poland

    Public procurement law is a significant area of GJW law practice. Our team provides comprehensive legal support on every stage of procurement proceedings – both for contracting authorities and contractors. We also support procurement processes that are not subject to the Public Procurement Act.

    Public procurement law constitutes a key area of GJW’s legal practice. We provide comprehensive legal advisory services at all stages of public procurement and tender procedures in Poland, supporting both contracting authorities and economic operators, including foreign undertakings from the European Union participating in Polish public procurement procedures.

    Our team advises on public procurement procedures governed by the Polish Public Procurement Law, as well as on procurement processes not subject to that Act. We specialise, inter alia, in sector-specific procurement and procurement concerning public utility services. In our practice, we combine in-depth knowledge of public procurement law, European Union public procurement regulations and competition law with extensive practical experience in conducting complex, high-value public procurement proceedings.

    Legal support for foreign contractors in Polish public procurement

    Foreign contractors entering the Polish public procurement market face formal, procedural, and regulatory challenges. We support companies from the EU and outside Poland by providing clear, practical, and business-oriented legal advice, including:

    • assessment of eligibility to participate in Polish tenders,
    • analysis of public procurement rules and applicable procedures,
    • support in preparing compliant bids and tender documentation,
    • assistance during tender negotiations,
    • representation in appeal proceedings and disputes concerning public procurement.

    Our advisory services for contractors focus on minimizing the risk of bid rejection due to formal errors and ensuring full compliance with Polish public procurement law and EU public procurement regulations, taking into account the principles of competition law.

    Public Procurement Advisory: Construction, Infrastructure and Energy Projects

    Our public procurement practice is closely aligned with the recognised expertise of the GJW team in construction law, infrastructure investments and energy projects. We advise foreign undertakings (contractors) participating in tender procedures concerning complex investment projects, including construction works, energy infrastructure, industrial facilities and public utility networks.

    We support contractors involved in public procurement procedures relating to projects governed by construction law and energy regulations, in particular with regard to:

    • public procurement procedures for construction works and infrastructure investments;
    • tender procedures in the energy sector and public utility services;
    • projects co-financed from European Union funds and public funds;
    • long-term and high-value contracts involving specific technical, regulatory and operational risks.

    Our advisory services go beyond ensuring procedural compliance. As part of our legal support, we focus on the identification, mitigation and contractual allocation of legal and contractual risks. We specialise in legal advisory services provided throughout the implementation of construction investments in the energy sector, taking into account the interrelations and dependencies between public procurement law, construction law, infrastructure investments, energy regulations and contractual frameworks applicable to the execution of large-scale infrastructure projects.

    Public Procurement Law in Poland – Legal and Business Advisory for Foreign Investors

    We support foreign contractors and investors not only as a law firm specialising in public procurement law , but also as a trusted business partner engaged in the strategic assessment of investment projects implemented within the framework of public procurement in Poland. Our role goes beyond ensuring legal compliance and includes the identification and management of legal, regulatory and market risks associated with entering the Polish market and operating within the public procurement environment.

    We advise clients at all stages of public procurement-related investments—from the initial assessment of market entry strategies and eligibility requirements, through the preparation of tender submissions and negotiations, to contract performance and dispute resolution. Our in-depth knowledge of Polish public procurement regulations, sector-specific frameworks and local market practices enables us to provide advisory services that are both legally sound and commercially justified.

    By combining public procurement expertise with experience in construction and energy law, as well as a thorough understanding of the Polish investment market, we support foreign investors in structuring their participation in tender procedures in a manner that mitigates risk and protects capital. In the context of Poland’s dynamic economic development and the expanding public investment market, our approach enables clients to make informed decisions and to participate effectively in complex, capital-intensive public projects.
